The Danger Tip
Liability will activate whether the defendant has violated the applicable commonplace of care. In evaluating the defendant’s conduct, courts usually assess whether or not another skilled would have acted the same, or would have carried out themselves differently. For example, in a medical malpractice case where a doctor fails to diagnose the patient’s most cancers at an early stage, the court must evaluate whether or not one other doctor would have accurately diagnosed the cancer at such an early stage.
